1. Eligibility & Account Responsibilities

• You must be at least 18 years old or have legal guardian consent to use our services.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You agree to provide accurate, current, and complete information during registration and to update it as necessary.

2. Service Description & AI Outputs

• fixki.de provides AI-assisted tools to generate code, design interfaces, and assemble application components based on your prompts and configurations.
• AI-generated outputs are provided dynamically and may contain inaccuracies, deprecated syntax, or require manual review before production deployment.
• We do not guarantee that generated applications will be error-free, secure, or fully compliant with third-party platform guidelines (e.g., App Store, Play Store).

3. Intellectual Property & Licensing

• You retain full ownership rights to your inputs, project specifications, and the final applications you generate and deploy.
• We grant you a worldwide, non-exclusive, royalty-free license to use, modify, distribute, and commercially exploit AI-generated outputs.
• fixki.de retains all intellectual property rights to the platform architecture, UI/UX, branding, underlying AI tooling, and proprietary algorithms.
• You may not reverse-engineer, decompile, or claim ownership over our core infrastructure, models, or proprietary workflows.

4. Acceptable Use & Prohibited Conduct

You agree not to use the platform to:

• Generate, distribute, or deploy malicious code, spyware, phishing tools, or any software intended to harm users or systems.
• Violate intellectual property rights, privacy laws, or export control regulations of Germany, the EU, or applicable jurisdictions.
• Scrape, crawl, or abuse our APIs, attempt unauthorized access, or bypass security and rate-limiting measures.
• Use generated outputs to train, fine-tune, or improve competing AI models or commercial services without our written consent.

5. Payments, Subscriptions & Refunds

• Services are offered on subscription, pay-as-you-go, or tiered plans as published on our website. All prices are in EUR and include applicable VAT unless stated otherwise.
• Subscriptions auto-renew until cancelled. You may cancel anytime via your dashboard; access continues until the current billing period ends.
• Refunds comply with EU consumer protection laws. For digital services, the 14-day right of withdrawal expires once service performance has begun with your explicit consent.

6. Disclaimers & Limitation of Liability

• Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted operation.
• fixki.de shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or business opportunities.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, to the maximum extent permitted under German law (BGB).

7. Termination & Suspension

We reserve the right to suspend or terminate your access immediately, without prior notice, if:

• You materially breach these Terms, our Acceptable Use Policy, or applicable laws.
• Your account poses a security risk, violates third-party rights, or engages in fraudulent or abusive behavior.
• You voluntarily request account deletion via settings or support.

8. Third-Party Services & Integrations

Our platform may link to or integrate with third-party APIs, libraries, hosting providers, or app marketplaces. Their respective terms, privacy policies, and availability apply. We do not endorse or assume responsibility for third-party content, services, or downtime.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in Berlin/Rüdersdorf bei Berlin. Mandatory consumer protection rights under EU and German law remain unaffected.

We may revise these Terms to reflect legal, technical, or operational changes. Material updates will be communicated via email or a prominent in-platform notice at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
